Health Care Reform Arguments

Starting March 26, the Supreme Court began its three days of hearing opposing arguments challenging the constitutionality of the Affordable Care Act.

Day three of the health care arguments questioned the individual mandate: if the justices strike down a key provision of the law, what other provisions would fall with it?

The Obama administration argued if the mandate falls, then two other provisions must die with it:

  1. Those that prohibit insurers from declining covers.
  2. Charging higher premiums because of pre-existing medical conditions.

Later that afternoon, the justices heard arguments about the law’s expansion of Medicaid.

Health Care Reform

Recently, the Supreme Courts heard six hours of oral arguments over three days on the Patient Protection and Affordable Care Act, which would require every person in the United States to purchase health insurance.

The mandate brought Americans from both sides of the issue to Washington.

A decision is not expected from the Supreme Court until the summer, but broker Reid Rasmussen of Benefit Brainstorm in McKinney, Texas, believes “regardless of what specific decisions come out of this, I don’t believe we’ll see a full repeal. So many pieces of the law have already been implemented, which I don’t foresee being taken away.”

Increase Usage of HSAs

With the growth in consumer-directed plans, banks are seeing an increase usage of health savings accounts (HSAs).

Bank of America recorded a 34% growth in HSAs in 2011, adding more than 50,000 accounts!

HSAs are used to work with a high deductible health plan. The account is owned and managed by the employee and earns tax-free interest. It can be carried over from year-to-year and moves with the employee wherever the employee goes – new job, changing health plans or retirement.

Kevin Crain, head of Institutional Retirement and Benefit Services for Bank of America Merrill Lynch explains some of the benefits of HSA accounts.

“In addition to the tax benefits, these accounts offer individuals more control over their health care spending and the option to accumulate longer-term health savings,” says Kevin Crain, head of Institutional Retirement and Benefit Services for Bank of America Merrill Lynch. “They also encourage more responsible use of health services and lifestyle decisions.”
